Can the bank just come and kick me out of my house?
This is a common misconception among my clients, and a lot of well intentioned individuals. The answer in the state of Florida is that a foreclosure lawsuit by the bank has to go through the entire Judicial Court process. While I often get asked the question when someone is served with a lawsuit and calls our office, how much time do I have or am I going to be locked out quickly?
The answer is a foreclosure lawsuit on a very rapid pace, if you’re fast-tracked is a number of months. Most often we’re talking about a year or two before we’re dealing with any kind of final hearing date or trial. That allows us plenty of time to then try and work something out with the bank or take the case to trial if we need to.
