Do I have to move out of my home during the foreclosure process in Florida?

Generally speaking now, the foreclosure process dealing with a bank foreclosure can be as quick, if we’re fast-tracked, it’s a couple of months, or can last as long as a year or two. During that time period, the borrower, our client, who’s also the homeowner, retains title to the property. That’s why they have the right to still remain in the property. During that time period, that year or so, on the fast-track even a couple of months, we’re able to start negotiations with the bank to see if we can have some kind of other resolution where both sides are happy long-term.

Then if we’re not able to, we’re not afraid to go to trial. I’ve handled hundreds of trials in Broward County dealing with mortgage foreclosure actions. A lot of times, just putting the pressure on the bank of going to trial will help then bring forth a resolution where our clients are able to retain the property.
