Are there alternatives to litigation in a Florida personal injury case?
In a personal injury case there’s generally two stages. There’s the pre-suit stage, which I would say is pre-suit litigation. Then, there’s the in-suit stage, and that’s after you file a complaint and now it’s considered, “in-suit.” The alternatives are to resolve it without the filing of a complaint, or to file a complaint and to push it through the litigation process. You know once you’re in the litigation process you can go to mediation and resolve it at that point as well. Ultimately, we tend to see better results if you’re pushing the insurance companies and forcing them to litigate cases.
